The Service is accessible through thedivorceangels.com and app.thedivorceangels.com, including any related subdomains, applications, and features.
2. What the Service Does
Your Divorce Angel provides tools and AI-powered guidance to help individuals navigate the financial aspects of separation and divorce. This includes settlement modeling, expense tracking, document analysis, and conversational support from our AI assistant ("Angel").
3. Not Legal, Financial, or Tax Advice
Information, estimates, calculations, and AI-generated responses provided through the Service are for general informational purposes only. We do not provide legal advice, financial advice, investment advice, or tax advice, and no lawyer-client, advisor-client, or fiduciary relationship is created by your use of the Service.
You should always consult with a qualified licensed professional in your jurisdiction before making any decisions about your divorce, finances, taxes, or legal rights. Outcomes depend on facts and laws specific to your situation, which the Service cannot fully assess.
4. Eligibility
You must be at least 18 years of age and legally able to enter into a binding contract in your jurisdiction to use the Service. By using the Service, you represent that you meet these requirements.
5. Accounts
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Keep your login credentials confidential
- Notify us promptly of any unauthorized use of your account
- Be responsible for all activity that occurs under your account
We may suspend or terminate your account at our discretion if you violate these Terms.
6. Subscriptions and Payments
Certain features of the Service may require a paid subscription. Pricing and billing details will be disclosed at the point of purchase. By subscribing, you authorize us (and our payment processor) to charge your chosen payment method on a recurring basis until you cancel.
You may cancel your subscription at any time through your account settings. Cancellations take effect at the end of the current billing period. Except where required by law, we do not offer refunds for partial billing periods.
Payments are processed by third-party providers (such as Stripe). We do not store your full payment card details on our servers.
7. User Content
You retain ownership of information, documents, and content you upload or input into the Service ("Your Content"). By submitting Your Content, you grant us a limited, non-exclusive license to store, process, and use it solely to provide the Service to you, including generating AI responses and producing outputs you request.
You are responsible for ensuring Your Content is accurate and that you have the right to share it. You agree not to upload content that is unlawful, infringing, defamatory, or harmful.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service
- Reverse engineer, scrape, or copy the Service or its underlying technology
- Interfere with, disrupt, or overload the Service
- Impersonate another person or misrepresent your identity
- Use the Service to harass, harm, or threaten others
- Upload malware, viruses, or other harmful code
9. Intellectual Property
The Service, including all software, text, graphics, logos, and design elements, is owned by Divorce Angels Inc. or our licensors and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-transferable, revocable license to use the Service for its intended personal purpose.
10. AI-Generated Content
Responses from "Angel" and other AI features are generated by artificial intelligence and may contain errors, inaccuracies, or outdated information. AI responses should not be relied upon as authoritative. Always verify important information with a qualified professional.
11. Third-Party Services
The Service integrates with third-party providers (including Anthropic, Supabase, Netlify, Google Analytics, and Stripe). These third parties have their own terms and privacy practices, which we do not control. Your use of third-party services is subject to their terms.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not warrant the accuracy of any calculations, estimates, or AI-generated content.
13. Limitation of Liability
To the fullest extent permitted by applicable law, Divorce Angels Inc. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service.
Our total liability to you for any claim arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim arose, or (b) CAD $100.
Nothing in these Terms limits liability that cannot be limited under applicable law, including in the case of gross negligence, fraud, or willful misconduct.
14. Indemnification
You agree to indemnify and hold harmless Divorce Angels Inc. from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your violation of these Terms, your misuse of the Service, or your violation of any rights of another person or entity.
15. Termination
You may stop using the Service at any time by closing your account. We may suspend or terminate your access to the Service at our discretion, with or without notice, if we believe you have violated these Terms or if we discontinue the Service.
Provisions that by their nature should survive termination (including Sections 7, 9, 12, 13, 14, 16, and 17) will survive.
16. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the courts located in Toronto, Ontario, and you consent to the jurisdiction of those courts.
17. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last Updated" date at the top and, where appropriate, notify you by email or through the Service. Your continued use of the Service after changes means you accept the updated Terms.
